Tiivistelmä
Opinnäytetyön tavoitteena oli Espoon perusopetuksen iltapäivätoiminnan kilpailutuksen kehittäminen. Tarkoituksena oli perinteisen eli tavanomaisen kilpailutuksen muuttaminen pilottihankinnan kautta uudella tavalla kilpailutettavaksi innovatiiviseksi hankinnaksi. Hankinnan tarkoitus oli kehittää pilotissa toimintamalli, joka järjestää perusopetuslain mukaista iltapäivätoimintaa 1. ja 2. vuosiluokan oppilaille sekä oppilaille, joilla on erityisen tuen päätös.
Opinnäytetyön teoriaosuudessa käsiteltiin lyhyesti julkisten hankintojen perusteita, hankintamenettelyn valintaa, CPV-nimikkeistöä, ESPD-asetusta, NUTS-koodistoa, tietosuoja- ja tilaajavastuulakeja sekä rikosrekisteriotteita yrityksen ja lasten kanssa työskenteleviltä.
Opinnäytetyön rakenne perustuu Espoon hankintakeskuksen uuteen hankintaprosessiin. Kaikkia hankinnan prosessivaiheita ei ollut vielä valmiina, kun perusopetuksen iltapäivätoiminnan pilottivaiheen kilpailutus aloitettiin syksyllä 2018. Opinnäytetyössä on kerrottu eri kilpailutusvaiheet hankinnan valmistamisesta ja kilpailutuksen etenemisestä kohti palvelusopimusta. Lopuksi työryhmä kävi läpi, kenen toimijan kirjoittama palvelukuvaus ja hinnoittelu vastasivat parhaiten asetettuihin vaatimuksiin. Hankinnassa tehtiin päätös perusopetuksen iltapäivätoiminnan toimijasta ja varatoimittajasta.
Opinnäytetyössä on kerrottu, kuinka pilottivaiheen hankinta on laadullisesti onnistunut. Missä laadullisissa asioissa kilpailutus onnistui ja missä oli vielä haasteita huomioiden seuraava innovatiivinen kilpailutus. Lisäksi opinnäytetyössä kerrottiin, mitä voisi vielä huomioida tulevassa innovatiivisen kilpailutuksessa. The aim of the thesis was to change the procurement procedure of the basic education in Espoo from traditional, conventional competitive tendering into an innovative procurement procedure through a pilot procurement. The purpose of the pilot procurement was to develop an operating model which organizes after-school activities for the first and second class pupils as well as for the pupils with a special support decision in accordance with the Basic Education Act.
In the theoretical part of the thesis, the public procurement criteria, the selection of the procurement procedure, the CPV nomenclature, the ESPD regulation, the NUTS code, the Data Protection Act and the Act on the Contractor´s Liability as well as the criminal record extracts of employees working with children and companies were briefly addressed.
The thesis structure is based on the new procurement procedure in Espoo Supply Centre. Not all the procurement procedure phases were finished yet as the pilot phase of the after-school activities in the basic education began in the autumn 2018. The thesis describes the different stages of the tendering procedure from the preparation of the procurement and the progress of the competitive tendering towards a service contract. Finally, the Working Group considered whose service description and pricing, as written by the service providers, best corresponded to the requirements, and a decision was made on the service provider and the deputy service provider of the after-school activities in the basic education.
The final procurement report shows how the pilot phase procurement had succeeded in terms of quality, what the strengths were when drafting the invitation to tender and what the challenges of the following competitive tendering would be. In addition, the final report shows which opportunities the upcoming innovative competitive tendering can have.
