Tiivistelmä
Informaatiota on perinteisesti välitetty yhteiskunnassa taholta toiselle kapseloimalla sitä fyysisiin tallennusvälineisiin. Monia aineettomia esineitä on siksi voitu lainsäädännössä luontevasti käsitellä aineellisten esineiden tavoin. Kapselointi onkin esimerkiksi tekijänoikeuslaissa muodostunut informaatioon liittyvien oikeuksien sekä teosten välittymisen keskeiseksi kontrollointitavaksi. Kapseloidun tiedon malli ei kuitenkaan sovellu pilviteknologiaan perustuvien vertaisverkkojen kuvaamiseen täysin luontevasti ja vertaisverkot ovatkin viime vuosina mullistaneet viestintäyhteiskunnan rakennetta tavalla, johon lainsäätäjä ei toistaiseksi täysin ole kyennyt vastaamaan.
Tutkielman pyrkimyksenä on ollut löytää kapseloinnista ja sen menetyksestä selitys sille, miksi vertaisverkot ovat lainsäädännön näkökulmasta niin ongelmallisia kuin ne ovat. Oikeuden monitieteisiin lukeutuva tutkielma syventyy tarkastelemaan vertaisverkkojakelun oikeudellisten kontrollointipyrkimysten tähänastisia vaikutuksia sekä tehokkaan kontrolloinnin teoreettisia edellytyksiä. Katsaus luodaan myös vertaisverkkojen teknisiin piirteisiin, kapseloinnin historiaan sekä vertaisverkkojakelun lähitulevaisuuden kehitysnäkymiin kolmiulotteisten tulostusmallien sekä digitaalisten kryptovaluuttojen muodossa.
Tutkimuspäätelminä työssä todetaan, että kapseloinnin menetys saattaa hyvinkin olla pääasiallisena syynä vertaisverkkojen vaikutuspiirin ongelmiin ja ennen kaikkea nykyisen tekijänoikeuslain ongelmallisuuteen. Lainsäätäjän pyrkimys kontrolloida ongelmia perinteisen, kapselointiin tukeutuvan lainsäädäntätekniikan avulla ei ole johtanut toimiviin oikeudellisiin käytäntöihin, vaan kontrollointipyrkimykset ovat aiheuttaneet lähinnä merkittävää yhteiskunnallista haittaa. Vertaisverkkojen aiheuttaman lainsäädännöllisen muutospaineen voidaan myös perustellusti ennustaa voimistuvan lähitulevaisuudessa teknologisen kehityksen seurauksena.
Ratkaisuksi tarkastelussa ilmenneisiin ongelmiin tutkielma esittää kapselointiin nojautuvasta lainsäädäntätekniikasta luopumista ja vaihtoehtoisten, innovatiivisten lainsäädäntätekniikoiden kehittelyä. Mahdollisina ratkaisun toteuttamistapoina käydään läpi muun muassa tekijänoikeuslain kokonaisuudistus ja osittaisuudistus sekä vertaisverkkojen juridisen sääntelyn erottaminen yleisestä tekijänoikeudesta omaksi erityisoikeudenalakseen.

Information has traditionally been shared within society by encapsulating it in physical objects, such as books and paintings. This encapsulation has enabled many immaterial objects to be treated as physical ‘items’ in the relevant copyright legislation, and encapsulation has thus formed the basis upon which the copyright legislation for controlling information-related rights, and distribution, is founded. Cloud-computing-based peer-to-peer networks pose problems with some areas of the legislation, since they do not easily fit within the definition of encapsulated information. As a result, during the last few years, these networks have altered the structure of the information society in such a way that the legislator has been unable to respond accordingly.
The objective of this thesis is to examine the legislative problems of peer-to-peer networks from the perspective of encapsulation and to determine whether the loss of this encapsulation could explain the legislative problems of peer-to-peer networks. In this “law and” study the effects of the legislative measures taken in the attempt to control peer-to-peer networks are examined, as well as the theoretical requirements for achieving effective control thereof. An insight is also taken into the technical features of peer-to-peer networks, the history of encapsulation and some near-future prospects of peer-to-peer technology, specifically in the areas of 3D printing and digital crypto-currencies.
In conclusion, the loss of encapsulation may well be the primary cause for the legislative problems of peer-to-peer networks as well as the friction currently present in the copyright legislation. It was found that the attempts to control these problems through conventional, encapsulation-based, legislative techniques have not lead to functional legal practices but have in fact caused notable collateral damage in society instead. The legislative pressure induced by peer-to-peer networks can also be expected to increase in the near future as a direct result of technological progress.
As a remedy to the aforementioned problems, the forfeiting of encapsulation-based legislative techniques and the development of new, innovative alternatives is suggested. As possible methods of implementation, complete and partial reforms of the copyright legislation are examined, as well as the idea of detaching the judicial control of peer-to-peer networks from the general copyright law as its own, separate, field of law.
