Tiivistelmä
Pro gradu -tutkielmassani tarkastellaan lasten ja nuorten kokemaa väkivaltaa, osallisuutta ja viran-omaisten yhteistyötä esitutkintapöytäkirjojen mukaan. Tätä tarkastelua tehdään seuraavien tutki-muskysymyksien avulla: Mitä lapset ja nuoret kertovat heidän kokemastaan väkivallasta poliisin kuulustelupöytäkirjoissa? Miten lasten ja nuorten osallisuus rakentuu poliisin esitutkintapöytäkir-joissa? Mikä on viranomaisten yhteistyön merkitys lasten ja nuorten asemaan esitutkintapöytä-kirjoissa? Lasten ja nuorten kuulustelut ovat merkittävä osa poliisin työkäytäntöjä, mutta niillä on merkityksensä lapsen ja nuoren aseman rakentumisen myötä myös lastensuojelun sosiaalityön nä-kökulmasta. Poliisin tekemiä lasten ja nuorten kuulusteluja on tutkittu vähän työkäytäntöinä, erilli-sinä vuorovaikutustilanteina ja yhteistyökäytäntöinä.
Tutkielman aineisto muodostuu poliisien tekemistä 17:tä esitutkintapöytäkirjasta ja yhdestä rikosil-moituksesta, ja se pitää sisällään 21 lasta ja nuorta, joihin on kohdistunut väkivaltaa joko seksuaali-sen hyväksikäytön tai pahoinpitelyn muodoissa. Esitutkintapöytäkirjoista tarkastelun kohteina ovat olleet erityisesti lasten ja nuorten sekä vanhempien kuulustelukertomukset ja lastensuojeluviran-omaisten tutkintapyynnöt asiakirjaliitteineen. Tutkielman metodologiset lähtökohdat ovat institutio-naalisen vuorovaikutuksen tutkimuksessa ja tekstin tutkimuksessa, mihin ovat vaikuttaneet esitut-kintapöytäkirjoissa paikantuvat useat eri institutionaaliset kontekstit sekä lasten ja nuorten kuuluste-luiden institutionaalisten vuorovaikutusdiskurssien kriittinen tarkastelu. Tutkielmani analyysi nou-dattaa kriittisen diskurssianalyysin periaatteita, jonka rinnalla analyysissä hyödynnetään hermeneut-tis-fenomenogian ajatusta jatkuvasta prosessin hakemista ja uusien kysymyksien asettelusta. Näiden avulla mahdollistuvat esitutkintapöytäkirjoista esiin tulevien käytäntöjen ja institutionaalisten vuo-rovaikutussuhteiden ymmärtäminen, kuvaaminen, tulkinta ja selittäminen.
Tutkielmani keskeiset tulokset kertovat lasten ja nuorten asemasta väkivallan uhreina. Keskeisintä on, että lasten ja nuorten kuulustelut rakentuvat vuorovaikutuksellisesti kertomustilaksi suhteessa kuulustelutilaan ja siellä oleviin henkilöihin, mikä mahdollistaa lasten ja nuorten väkivallasta ker-tomisen. Institutionaalisessa vuorovaikutustilanteessa lapset ja nuorten kertovat iästä riippumatta väkivallasta samalla tavoin. Heidän kerrontansa on avointa, suoraa, mutta niukkaa, ja väkivaltaa kuvaavat sanat ovat muodoiltaan samoja, mitä aikuiset käyttävät. Lasten ja nuorten osallisuuden rakentuminen on heistä itsestään lähtöisin olevaa, mutta myös suhteessa siihen, miten vanhemmat ja viranomaiset toimivat. Lasten ja nuorten aseman rakentuminen osallisuuteen ei vaikuta noudattavan sosiaalityössä tunnistettavia osallisuuden piirteitä eikä niiden hyötyjen merkityksiä. Viranomaisten yhteistyö toimii esitutkintapöytäkirjoissa lainmukaisesti, mutta lasten ja nuorten aseman näkökul-masta viranomaiset tekevät turhaa päällekkäistä työtä. Yhteistyömuotoja ja osallisuuden mallinta-misen avulla lasten ja nuorten asemaan sekä heidän perheidensä tilanteisiin pystyttäisiin vaikutta-maan kohdennetusti.
The Position of Children and Young in Pretrial Investigation After Having Experienced Violence – A Study of Experienced Violence, Implication and Collaboration of Authorities According to Pretrial Minutes
This Master ́s thesis reviews the position of the children and the young as victims of violence, in the minutes of the pretrial done by the police. This review is conducted through the following research questions: What the children and the young tell in police hearing minutes about the experienced violence? What is the significance of the cooperation of the authorities to the position of the children and young regarding minutes of the pretrial? The hearings of the children and the young are part of police working practice but they have their significance within the build of the position of the children and the young from the social work point of view. Police hearings of the children and the young as working practice, separate interaction situations and collaboration practice is studied marginally.
The research material consists of 17 pretrial minutes conducted by the police and one report of an offence. These include 21 children and young who have encountered either sexual or physical violence. In the pretrial minutes especially the hearing reports of the children and the young and their parents and the documentation of the requests for investigation done by the childcare authorities are surveyed. The methodological starting point of this research is in the studying of institutional interactions and the content of the texts. These have been affected by numerous different institutional contexts and critical reviewing of the institutional interaction discursion of the hearings. The analysis in this study follows the principles of the analysis of discursion by which it is exploited the hermeneutic-phenomenological idea of constant processing and setting new questions. Through these itis possible to understand, picture, interpret and explain the appearing practices and institutional interactions in pre-trial minutes.
The fundamental results of this study tell about the position of the children and the young as victims of violence. The most essential is that the hearings of the children and the young build into an interactive narration in relation to the hearing space and persons in it which enables the telling about violence experienced. Despite their age, in institutional interaction the children and the young tell about violence the same way. Their narration is open and direct but short. The descriptive words of violence are the same as used by adults. The building of the implication of the children and the young starts from themselves but is related to how parents and the authorities act. The building of the position of the implication does not seem to follow the features of implication recognized in social work nor the meaning of the benefits. Collaboration of the authorities work in pretrial minutes according to law, but from the children’s’ and young’s’ points of views, the authorities do unnecessary overlapping work. By different cooperation forms and modeling the implications, the situations of the target families could be affected more precisely.
Tutkielman aineisto muodostuu poliisien tekemistä 17:tä esitutkintapöytäkirjasta ja yhdestä rikosil-moituksesta, ja se pitää sisällään 21 lasta ja nuorta, joihin on kohdistunut väkivaltaa joko seksuaali-sen hyväksikäytön tai pahoinpitelyn muodoissa. Esitutkintapöytäkirjoista tarkastelun kohteina ovat olleet erityisesti lasten ja nuorten sekä vanhempien kuulustelukertomukset ja lastensuojeluviran-omaisten tutkintapyynnöt asiakirjaliitteineen.
