Tiivistelmä
Laki lapsen huollosta ja tapaamisoikeudesta uudistuu. Lakiin tulee muutos lapsen tapaamisoikeuteen. Aikaisemmin lapsella on ollut oikeus tavata sitä vanhempaa, jonka kanssa hän ei asu. Hallituksen esityksessä uudeksi lapsenhuoltolaiksi on ehdotettu, että jatkossa lapselle voidaan vahvistaa oikeus tavata myös muuta hänelle läheistä henkilöä kuin vanhempaa. Oikeusministeriö järjesti avoimen verkkokeskustelun osana lain valmisteluprosessia vuonna 2016. Aineistona käytetään verkkokeskustelun osaa, jossa käsitellään lapsen tapaamisoikeuden laajentamista. Tutkielman lähestymistapana on laadullinen asennetutkimus, joka toimii myös aineiston analyysimenetelmänä. Keskiössä on tekstiaineiston käytetty kieli, jonka kautta verkkokeskusteluun osallistuneiden kannat, perustelut, kokemukset sekä äänet tulevat kuuluviin.
Tutkielmassa tarkastellaan perheeseen liittyvä asenteita ja perhekäsityksiä tapaamisoikeuden laajentamisesta. Erityisesti perehdytään siihen, miten asenteita ja käsityksiä perheestä on perusteltu. Aihetta lähestytään lakiuudistusta taustoittamalla, kokemuksellisen kansalaistiedon näkökulmasta sekä perehdytään perhetutkimukseen ja eri tapoihin jäsentää perhettä. Laajempi sukupolvisuhteita sisältävä käsitys perheestä sisällyttää myös isovanhemmat lapsen perheeseen. Suppeampi ydinperhemalli näkee perheen koostuvan vanhemmista lapsineen. Perhekäsitykseen vaikuttaa lisäksi yhteiskunnan yksilökeskeisyys tai yhteisöllisyys.
Tutkimustuloksissa tapaamisoikeuden laajentamista kannattavat perustelevat asennettaan kolmella tavalla. Isovanhemmuutta pidetään lapselle suotuisana ja merkityksellisenä pääomana, jonka puuttuminen on menetys. Toiseksi lapsi tulee pitää keskiössä, jotta saadaan näkyväksi jatkuvat läheiset ihmissuhteet, kuten isovanhemmat. Sukuyhteys voi olla ristiriitainen; tapaamisoikeuden laajentamisesta huolimatta vanhempi säätelee ja kontrolloi yhteydenpitoa sukulaisiin, erityisesti omiin vanhempiinsa. Tapaamisoikeuden laajentamista vastustaneet perustelevat asennettaan vanhemman vallalla sekä lapsen suojelulla. Yhteydenpito sukulaisiin on jokaisen oma valinta. Lapsen ääneen vedotaan, kun korostetaan tilanteiden tapauskohtaisuutta, lapsen tahdon kunnioittamista sekä läheisen henkilön merkityksellisyyttä arvioitaessa. Lapsen kanssa asuminen nähdään merkityksellisemmäksi kuin sukulaisuus. Välttelevästi tapaamisoikeuden laajentamiseen asennoituneiden äänissä kaikuvat vaimeampina aikaisemmat perustelut vanhempien ensisijaisuudesta, isovanhempien sekä lapsen ääni. Asenteista voi johtaa laajemman, isovanhemmat ja sukulaisia sisältävän tai ydinperhemallia soveltavan perhekäsityksen, jossa lapsella voi olla kaksi ydinperhettä mukailevaa perhettä eron jälkeen molempien vanhempiensa luona.
Lastenvalvojan tehtävissä työskentelevät sosiaalityöntekijät ovat avainasemassa kartoittamaan lapselle tärkeitä henkilöitä eron jälkeen yhdessä lapsen, vanhempien ja huoltajien kanssa, lapsen näkökulmasta käsin. Tässä tehtävässä on tärkeää olla tietoinen erilaisista taustalla vaikuttavista asenteista ja perusteluista, joita lapsen tapaamisoikeudesta keskusteleminen aikuisissa herättää.
ABSTRACT
The Act on Child Custody and Right of Access is reforming. Child has a right to maintain contact and meet with the parent with whom she or he doesn´t reside. There is an amendment in the Government proposal, that child should have a right to meet and maintain contact with someone other than the parent, whom she or he has a close relationship with, along with the parent. The Ministry of Justice held an open online discussion in the year 2016 as a part of preparation of a legislative proposal. The data in this study consists of text material which was produced by the online discussion´s participants. This is a qualitative study which concentrates on analyzing attitudes and stance taking. The language in the data is essential because it shows the stances, attitudes, arguments, reasoning and experiences that the conversationists have and enables their voices to be heard.
The attitudes toward family, family concepts and perceptions about family are in the centre. In the discussion the participants were debating over the subject, should the child´s right be expanded. The exact interest is in the ways in which these attitudes have been argumented and explained. The backgroundings of the subject consists of the government´s drafting of legislation, experience-based knowledge that citizens have and the various explanations about family. The understanding about family is related to society and it´s culture in general. Some countries and cultures are considered to be more collectivist or more individualist than others.
According to this research outcomes, the supportive attitude towards the child´s expanded right of access is justified in three ways. Firstly, granparents form a sort of beneficial and significant capital for the grandchild and the missing role of grandparents is a loss for the child. Secondly, a child should be kept in the center, when close relationships, such as granparents, are being estimated. The connection with relatives can be ambivalent. A parent should have a right to supervise and control the family connections, especially with the parents of one´s own. Attitude against the expanded right was explained by the power of parent and protection of the child. Contacting relatives is one´s own choice. People refer to a child´s point of view when they want to underline the case-spesific situation, respecting the child´s will or when evaluating the significancy of close relationships. Living with a child is more significant than relatedness. The third group was reluctant to taking a clear stance and their attitudes were more hidden. They echoed the former reasons, such as grandparents voice, child´s voice and parents first, when discussing about the right of access.
The conclusion from the attitudes is family conceptions of two kinds. A wider concept of a family include grandparents and other relatives. The other concept of a family means that after parents separation, a child can have simultaneously two families which both imitate the foundation of a nuclear family. Social workers work in municipal family law matters and make agreements with the separated parents about their child´s custody, place of residence and the right of access. They play a key role in surveying close relationships that a child can have besides the parents and the providers. It makes the process easier if one is aware of the attitudes and the statements around the subject.
