Tiivistelmä
Tämän opinnäytetyön tarkoituksena on kuvata millaisia mahdollisia ajallisia muutoksia haastemiehet kokevat heidän toimittamissaan tiedoksiannoissa. Opinnäytetyössä ollaan kiinnostuneita myös siitä, kuinka mahdollisena haastemiehet kokevat tiedoksiantojen sähköistymisen lähitulevaisuudessa. Tämä onkin melko ajankohtainen aihepiiri, sillä sähköistymisen yleistyessä henkilökohtaisesti toimitettava haastetiedoksianto alkaa olla jo melko vanhanaikainen tiedotustapa.
Tutkimus toteutettiin kvalitatiivisena tutkimuksena teemahaastattelujen avulla. Tutkimusongelman ratkaisemiseksi työssä haastateltiin kolmea Keski-Suomen käräjäoikeuden alaisena työskentelevää haastemiestä kevään 2018 aikana. Tutkimusaineisto litteroitiin tekstimuotoon analyysia varten. Haastatteluista saatuja tuloksia analysoitiin koodaamalla eli litteroiduista aineistosta eroteltiin ne asiat, jotka vastasivat tutkimuskysymyksiin.
Tutkimuksen tuloksista selvisi, että suurimmat vaikuttavimmat tekijät haastemiesten toimittamiin tiedoksiantoihin olivat vuoden 1993 alioikeusuudistus, matkapuhelimien yleisty-minen ja käräjäoikeuksien yhdistyminen vuonna 2010. Lähitulevaisuudessa tiedoksiantojen muuttuminen täysin sähköiseksi koettiin haastemiesten keskuudessa melko mahdottomana. Heidän näkemyksensä mukaan haastemiehet tulevat toimittamaan tiedoksiantoja vielä viiden vuoden päästäkin.
Tutkimus auttoi ymmärtämään haastemiesten kokemaa muutosta työssään ja sitä, kuinka haastemiehet kokevat näiden muutosten vaikuttaneen konkreettisesti heidän tiedoksiantoihin. Tutkimustulosten pohjalta voidaan todeta, että haastemiehet ovat edelleen tärkeä osa ihmisten oikeusturvaa. The purpose of this study is to search how notice of enforcements have changed and how bailiffs have experienced these changes. In addition, bailiffs’ views about notice of enforce-ments’ future is searched. The spread of digitalization has made personally delivered notice of enforcement an old-fashioned way to contact people and therefore, this work also clari-fies whether the interviewed bailiffs believe that service procedure is going to be digitalized in the future.
This research was carried out as a qualitative research where interviews were done through as a theme interviews during spring 2018. The Interviews were transcribed into text format for the analysis. To solve the research question three bailiffs working in Central Finland Dis-trict Court were interviewed. Results from interviews were coded and therefore, answers for the research questions were separated from transcribed data
The results concluded that the most significantly affecting factors to notice of enforcement delivered by bailiffs were court procedural reform of 1993, mobile phones and fusion of dis-trict courts in 2010. In addition, the near future of notice of enforcements was experienced quite constant but they also see the possibility of completely electronic delivery of notice of enforcement in near future. The interviewed bailiffs believed to deliver notice of enforce-ment still after five years.
This research helps to understand the possible changes bailiffs have been experiencing in their work and how the changes have affected to the substantial process of notice of en-forcement. Based on these gathered results, it can be concluded that bailiffs have still an important part of people’s legal protection.
