Tiivistelmä
Opinnäytetyön tarkoituksena on tehdä opas kiinteistönvälitysliikkeelle myyntitoimeksiantosopimuksen tekemiseen liittyvistä asioita, kun myyjänä on aviopari tai kuolinpesä. Erityisesti tarkastellaan myyntitoimeksiantosopimuksen kohtaa, jossa kysytään myyjäpuolen osituksesta, onko se tehty avioeron jälkeen tai lesken ja edesmenneen puolison välillä. Työskentelen kiinteistönvälittäjänä ja työssäni keskustelen usein asiakkaiden kanssa osituksen merkityksestä. Toiminnallinen opinnäytetyöni koostuu teoria- ja opasosasta. Kiinteistönvälittäjä voi oppaan avulla tarkistaa, mitä asiakirjoja tarvitaan myyntiä varten, kun aviopari tai kuolinpesä on myyjinä. Oppaan tarkoituksena on antaa kiinteistönvälittäjälle tiedot tarvittavista asiakirjoista. Hän voi antaa oppaan myyjälle, jotta tämä ymmärtää koko myyntiprosessin sopimuksen tekemisestä kaupantekemiseen ja miksi ostaja tarvitsee tiettyjä tietoja kaupan jälkeen. Opas on laadittu selkeäksi, jotta kiinteistönvälittäjä voi nopeasti tarkistaa asioita siitä. Opinnäytetyön tutkimusmenetelmä perustuu lakien tutkimiseen. Lähteinä on käytetty avioliittolakia, perintökaarta, muuta ajantasaista lainsäädäntöä, kirjallisuutta ja internet-lähteitä. Työssä on käytetty korkeimman oikeuden ratkaisuja esimerkkeinä. Tutkimusongelmana on, avio-oikeuden merkitys ja mitä avioliiton vallinnanrajoitukset ovat ja milloin avioliiton vallintarajoitukset päättyvät? Mitä vaikutuksia osituksella on, kun myydään yhteistä kotia, kun myyjänä on eroava pariskunta tai leski ja kuolinpesä? Kiinteistönvälittäjän tulee kertoa asiakkaille myyntisopimukseen liittyvistä asioita ja kysyä asiakkailta, onko ositus tehty ja miksi sitä kysytään. Lisäksi välittäjä tarkastelee tilanteessa, tarvitaanko puolison suostumus yhteisen kodin myyntiin ja arvioi mahdollisen luovutusvoiton verotusta. Kuolinpesän ja lesken ollessa myyjinä samat asiat nousevat esiin; kenellä oikeus myydä, osituksen vaikutus verotukseen ja lesken asema. Nämä asiat kuuluvat kiinteistönvälittäjän osaamisalueeseen ja ne muodostavat vastuukysymyksen välittäjälle. Kiinteistönvälittäjä voi neuvoa asioissa, mutta vastuun siirtämiseksi itseltään, hän voi neuvoa asiakasta kääntymään erityisasiantuntijan puoleen laki- tai verotuskysymyksissä. The purpose of this Bachelor's thesis is to create a guide for the real estate business in case the vendors are a married couple or an estate. The intention is to a point in the sales order agreement related to the partition made after the divorce or between the widow and the deceased spouse. The author works as real estate broker and often discusses with clients about partition. This functional thesis consists of a theory and a guide section. A real estate agent can use this guide to check which documents are needed for selling. He or she can provide a guide for the vendor to help understand the entire sales process of concluding a transaction and why the purchaser needs certain information after the transaction. This research includes following research questions: first, what is the marital right to property and what are the limitations of marriage and second, when will the marriage restrictions expire. The research method of the Bachelor's thesis is based on investigating laws. Marriage Act, Code of Inheritance, other up-to-date legislation, legal literature and online sources. As example some Supreme Court solutions are also utilized.

In addition, the broker examines whether the spouse's consent is required for the sale of the joint home and assesses the tax on the possible capital gains. When the estate and the survivors’ share is sold, the similar issues arise: first, who has the right to sell, and second what is the effect of the purchase on taxation and the widow's status. These matters belong to the area of competence of the estate agent and form the responsibility of the broker. The real estate agents can advise on matters, but in order to transfer responsibility from themselves, they can advise the client to consult a specialist on legal or tax issues.
