Tiivistelmä
Tietojohtamisen on osoitettu tehostavan organisaatioiden toimintaa. Tietojohtamisen haasteiden tutkinta on kuitenkin ollut vähäistä eikä aihepiiriä ole tutkittu lainkaan suomalaisten ratkaisuja antavien lainkäyttöelinten kontekstissa. Tämän tutkielman tarkoituksena on tutkia tietojohtamisen haasteita ratkaisuja antavissa lainkäyttöelimissä. Tutkielmassa selvitetään myös, mitkä ovat johtajan valinnalle asetetut lakisääteiset edellytykset ja minkälaisella johtamiskoulutuksella oikeusministeriö tukee johtajien työtä. Nämä taustatekijät auttavat osaltaan ymmärtämään tietojohtamistyössä kohdattuja haasteita. Tutkimuksen näkökulmana ovat nimenomaan suomalaiset ratkaisuja antavat lainkäyttöelimet eli tuomioistuimet ja lautakunnat johtajineen. Empiirinen osuus toteutettiin monitapaustutkimuksena, jota varten haastateltiin viittä johtajaa. Haastatteluaineisto tulkittiin ja analysoitiin tutkimustulosten integroimiseksi osaksi voimassa olevaa tietojohtamisen tutkimusta. Tutkimustulokset osoittavat, että lainkäyttöelinten johtajat kohtaavat useita tietojohtamistyön haasteita, joista osa johtuu lainkäyttöelinten ominaispiirteistä, kuten yksittäisen tuomarin riippumattomuudesta. Tutkimuksen voidaan katsoa edistävän nykyistä tietojohtamisen haasteiden tutkimusta, koska se antaa tietoa lainkäyttötyön toimintaympäristöstä. It has been shown that the knowledge management will intensify the operation of organisations. However, the investigation of the challenges of the information management has been minor and the subject matter has not been studied at all in the context of the Finnish judicial bodies which give judgements. The purpose of this thesis is to study the challenges of the information management in the judicial bodies which give judgements. In the thesis, it is also clarified what are legal preconditions set for the leader's choice and with what kind of management education the Ministry of Justice supports the leaders' work. These underlying factors contribute to understand challenges that are met in the knowledge management work. The point of view of this thesis are precisely Finnish judicial bodies which give judgements and boards with their leaders. The empiric share of the study was carried out as a multi case study for which five leaders were interviewed. The interview material was interpreted and analysed for the integration of research results for the knowledge management study. The research results show that the leaders of judicial bodies meet several challenges of the knowledge management some of which are caused by the characteristics of the judicial bodies, such as from the independence of the individual judge. The study can be considered to promote the present study of the challenges of the knowledge management because it gives information about the environment of the legal practice.
